Terms & Conditions


  1. Payment Terms
    1. All projects are undertaken subject to a 25% non-refundable deposit then a further payment of 50% at a milestone specified by us, with the remaining final balance 25% payable upon completion.
    2. Gulf Broadcast will not commence work on any project until a signed purchase order or equivalent signed document has been provided by the client.
    3. Gulf Broadcast’s fees shall be exclusive of disbursements and expense items, these will be agreed and invoiced to the client on the relevant project, or separately as necessary. Invoices are payable on presentation
    4. Any third party costs in relation to this agreement/quotation/invoice (eg, on-camera talent, voice-overs, duplication, art work, etc.) shall be applied to the client’s cost and are payable on receipt of the invoice(s).
    5. Payments may be made by bank transfer or cheque.
    6. All cheques must be made payable to “Gulf Broadcast”
  2. Bookings, Cancellation and Postponements
    1. Dates for production are agreed in advance and confirmed by the Client. Where these dates are cancelled whether due to a request from the Client or due to an amendment by the Client that results in a cancellation; the following charges shall apply where the shooting cancellation notice is given or is caused regardless of whether any facilities or services had been rendered in respect of the project.
    2. Client shall pay all expenses incurred by the Director up to time of cancellation, plus a fee to be agreed upon. If a shoot is canceled within 24 hours of departure for the shoot, Client shall also pay 50% of the anticipated director fee and 100% of the anticipated fee of any subcontractors booked for the job.
    3. If a project is canceled prior to completion, a cancellation charge equivalent to 25% of the project cost in addition to all services provided up to the cancellation date, including pre-production work, will be billed and shall be immediately payable by the Client.
  3. Non-Performance
    1. Where a Client or Gulf Broadcast sets a specific deadline for provision of facilities or services it is the customers sole responsibility to ensure all approvals are completed in good time to meet the deadlines.
    2. Any customer who fails to meet to deadlines or approval deadlines will incur the costs of overtime required for Gulf Broadcast to complete the project changes.
    3. Gulf Broadcast shall not be liable for any costs required for additional services to be rendered in order to complete the project to a satisfactory level if a client incorrectly books services with Gulf Broadcast.
  4. Contracted Work
    1. The customer’s requirement must be clearly provided to Gulf Broadcast in writing before commencement of work and subject only to one set of minor alterations thereafter.
    2. Major alterations to a project, not agreed prior to the commencement of work, must be made subject to a further written agreement.
    3. A film will only be publicly released by Gulf Broadcast once the customer approves all content as complete and satisfactory and confirms this in writing.
  5. Client Representation
    1. The Client is responsible for the presence of an authorized representative at the shoot to approve the Director’s interpretation of the assignment. If a Client representative is not present, the Director’s interpretation shall be deemed acceptable.
  6. Additional Usage
    1. If Client wishes to make any additional uses of the video(s) not previously agreed in the initial agreement, Client shall obtain permission from Gulf Broadcast and pay an additional fee to be agreed upon.
  7. Gulf Broadcast’s Rights
    1. Gulf Broadcast reserves the right to refuse to use, publish or  broadcast any information it considers obscene or morally unsuitable or which would breach copyrights, or which is libelous, defamatory or illegal.
    2. Should such a submission occur, the customer will be advised which information was deemed unsuitable, and requested to amend the information. If the customer can show good reason to use the “unsuitable” information, its inclusion may be considered.
    3. Gulf Broadcast cannot be held liable for loss or damage caused as a result of third party action or failure.
    4. The client shall provide appropriate security arrangements for any filming outside of Bahrain for which Gulf Broadcast provides crew or equipment and such arrangements shall be notified to Gulf Broadcast in writing in advance of travel to that jurisdiction.
  8. Amendments to Contract
    1. Gulf Broadcast cannot be held liable to any party for any errors on any medium after the customer has agreed in writing that the content is correct and accurate and should be posted, published or broadcast.
    2. Customer contracts may be modified by agreement in writing at any time to add or delete services to better fit the customer’s needs.
    3. If a project requires additional content, this is, in effect, a contract change. An amendment will be made to the original contract and, once approved, becomes contractually binding.
    4. E-mail correspondence shall be sufficient to prove changes to agreements for the form and content of programs provided the changes have been acknowledged by Gulf Broadcast  prior to them being implemented.
  9.  Copyright
    1. In consideration of, and subject to, the final payment of full fees due to Gulf Broadcast  hereby assigns to the customer with full title guarantee all the present and future copyright and other intellectual property rights howsoever arising in the delivered content. The client is not permitted to create any derivative work on the material supplied without giving full and proper credit to Gulf Broadcast in a visible manner.
  10.  Confidentiality
    1. Any confidential or proprietary information which is acquired by Gulf Broadcast from a client company, person or entity will not be used or disclosed to any person or entity, except when required to do so by law. If required, Gulf Broadcast will sign and adhere to the conditions of any Confidentiality Agreement used by the client.
  11. Hours of Business
    1. Any contract requiring Gulf Broadcast to work to specific deadlines provided within the written agreement will be deemed to include a proviso that the clients will make themselves reasonably available to communicate with Gulf Broadcast, its servants or agents, as necessary.
    2. Gulf Broadcast office hours are 8.00 a.m. To 5.00 p.m. Sunday to Thursday unless notified otherwise.
  12. Claims & Complaints
    1. Any claim must be made in writing to Gulf Broadcast within 7 days of receipt of goods. If no claim is made within this period the client is deemed to have accepted the goods at the agreed price.
    2. Should the customer have cause to make any complaint about  service or programs, the complaint, if put in writing, will be acknowledged by Gulf Broadcast within 14 days and a detailed reply will be issued to the customer within a further 28 days thereafter. In cases of complaint, all relevant work together with invoice and original materials should be returned to Gulf Broadcast.
  13. Force Majeure
    1. Gulf Broadcast shall be under no liability if unable to carry out any provision of the contract for any reason beyond its control including (without limiting the foregoing) Acts of God, legislation, war, riots, fire, flood, drought, failure of power supply, lock-out, strike or any other action taken by suppliers or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the client may, by written notice to Gulf Broadcast, elect to terminate the contract and pay for work done and materials used but subject thereto shall otherwise accept delivery when available.
